NOISE Database (NOISE DB) Terms and Conditions of Use

These Terms of Use relate to the NOISE Database (NOISE DB) website at noisedb.nal.gov.au  

By accessing or using this website, You are acknowledging that You have read, understood and agree to be bound by these Terms of Use.  When accessing this website You will be required to expressly accept these Terms of Use by clicking on the "I confirm" button at the time of accessing the website.

Definitions

1.      In these Terms of Use, unless the context indicates otherwise:

Data means all data, text, images, and/or information provided by Us on our website located at noisedb.nal.gov.au but not including Our logos and Our domain name.

NAL means National Acoustic Laboratories (research division of Australian Hearing Services ABN 80 308 797 003)

Our, Us and We means Australian Hearing Services ABN 80 308 797 003, a Commonwealth Government Entity, operating through its research division, the National Acoustic Laboratories

Personal Information has the same meaning as in the Privacy Act 1988 (Cth) as amended.

Product means any goods, publications, materials and Software made available by Us on this website.

Related Material means the printed materials provided and intended for use in conjunction with Software.

Software means any Product or part of a Product that is a computer program, together with any accompanying data.

work means all data, text, images, and/or information provided by Us on our website but not including Our logos and Our domain name.

You and Your means the user of this website.

     i.   provide Your data to Us free of charge and without conditions

     ii.   provide Us with Your personal information including your full name, email address and contact details so that we may verify your identity and the source of your data. We may also contact you for NOISE research unless you tell us otherwise. You must provide Your real name, phone number, email address and other requested information as indicated. (Please refer to the Privacy section of these Terms of Use for further information as to how We protect Your personal information). 

     iii.  verify the source of your data

     iv.  accept the Australian Hearing Privacy Policy found at www.hearing.com.au 

12.   We reserve the right to not accept any data from You at our discretion.

Licence Conditions for Data on Our website

13.   The data on our website is provided by Us to You under a Creative Commons Licence CC BY-NC-SA 3.0 Unported Licence (Attribution-NonCommercial-ShareAlike) and is subject to the following terms and conditions (Licence Conditions). 

14.   By accessing our website, You are indicating Your acceptance to the Licence Conditions.

Release and Indemnity

24.   To the extent permitted at law, You release Us and Our employees and agents in respect of all liability for Loss, damage or injury which may be suffered by You arising from Your use of this website.

25.   You agree to indemnify Us and Our employees and agents in respect of all Loss arising out of a negligent or unlawful act or omission in Your use of this website.

30.   These Terms of Use (including the Licence Conditions) are governed by the laws of the State of New South Wales, Australia, and You agree to submit to the exclusive jurisdiction of the courts of the State of New South Wales.

31.   If any of these Terms of Use (including the Licence Conditions) are held to be invalid, unenforceable or illegal for any reason, the remaining Terms of Use will continue in full force.
